96th Sitting of the Bureau

1. New legal initiative, regarding the enforcement procedures of the last residence house along with the amendments of the applicable laws have been registered by Patriotic Alliance at the Bureau sitting.

• An enforcement officer will be obliged to determine whether the residential home represents an only housing property of a debtor or his family; If following is established enforcement proceedings shall be halted for the period of 3 years.

• An amendment to the law on the Social Assistance states an additional type of the service which presupposes assignment of the minimal accommodation to the homeless.

2. Following amendments to the Attorney's Law and accompanying bills ( Author: committee assigned to address the issue) have been registered based on the initiative of E. Beselia's and G. Popkhadze's

• Attorney will be obliged not to disclose clients identity and the information related to the specific ongoing case (confidential information), in addition provision regarding certain circumstances when confidential information may be revealed shall be noted in the law.
• It shall be noted that a lawyer may be a citizen of Georgia, that has completed compulsory internship comprising of practical / theoretical training of the duration of 1 year.Internship program is being coordinated by the Executive Council of the Georgian Bar Association
• It shall be defined that an attorney will be a sole representative of the client with the relation of an Attorney Bureau

3. Legislative proposal pertaining to the amendments to Broadcasting and Election Code , initiated by the Georgian National Communications Commission has been registered at the Bureau sitting.

Noted proposal implies following.

Amendments to the Election Code:

• Media liability during the second round of the election period is being specified
• Bill prohibits political / pre-election advertisements that include: war & violence propaganda, call for the overthrow of the existing state / social systems, violation of the territorial integrity, call for the religious and ethnic confrontations, advertisement that creates a certain conflict based on the racial, ethnical , religious differences, includes discrimination or insult of either of the groups based on the physical disability, ethnicity, religion, worldview, sexual orientation, sex etc. openly encourages violence etc.
• Provision requiring Media to certain obligations in regards to the research or publication of the Opinion polls will be noted
• Etc.

Amendments to the Law on Broadcasting:

• Broadcaster is prohibited from placing social advertisement of the administrative body from the start of the appointment of the elections till the end of it. From the appointment of the elections till the end of it broadcaster will be obliged to submit the information delivered by an administrative body (except an electoral administration) relevant to the public to the National Communications Commission in order to determine its compliance with the law.
• An authorization / license for broadcasting shall be suspended if the license holder / authorized personnel will become an administartive body, representative of the administrative body , any other public official, legal entity relating to the administrative agency, political party representative, legal entity registered in offshore zone etc.
